High Court Awards US$25K In Adultery Compensation to Church Leader

Justice Joel Mambara delivered the groundbreaking verdict on April 27, 2025, marking one of the highest-ever awards for marital damages in the country’s legal history.
High Court Orders $25K Adultery Compensation to Church Leader
During court proceedings, Dr. Dhudhla described the emotional devastation caused by her husband Augustus Machingura’s relationship with Euginia Machaya, a Chiredzi villager. The retired academic compared her pain to “suffering relentless emotional lacerations” that affected both her health and dignity.

“The betrayal dismantled my world – from losing financial security to watching another woman assume my position in family affairs,” Dhudhla testified.
Court documents revealed how Machingura, a sugarcane farmer and war veteran, systematically removed his wife from their shared life, revoking her vehicle ownership, replacing her on business accounts, and even displacing her and their children from medical aid coverage in favour of Machingura’s family.
Judgment Reflects Societal Shifts
Justice Mambara emphasised that the US$25,000 award, surpassing Zimbabwe’s previous adultery compensation record of US$20,000, accounted for both economic changes and the case’s exceptional circumstances.
The ruling allocated:
- US$16,000 for emotional distress and humiliation
- US$9,000 for destruction of marital relations
The judge particularly noted Machaya’s complete absence of remorse, especially considering the affair produced two children during the plaintiff’s vulnerable health period.

Health Consequences of Marital Collapse
Dr. Dhudhla, managing diabetes and hypertension, testified that the stress triggered severe health complications requiring repeated hospitalisation since discovering the affair in 2019.
Currently dependent on court-ordered maintenance that her husband frequently neglects, the church leader now resides separately while Machingura lives with Machaya in Gutu.
Pauline Chimwanda of Saratoga Makausi Law Chambers provided legal representation for Dr. Dhudhla and successfully argued the landmark case.
